BINS ON THE MOVE, LLC Rental Agreement & Terms of Service
By placing an order with BINS ON THE MOVE, LLC (“BOTM”), the Renter acknowledges that they have read, understood, and agreed to this Rental Agreement & Terms of Service (the “Agreement”).
The following terminology applies to this Agreement: “Renter”, “You” and “Your” refers to you, the person purchasing, using and/or accessing our services and thereby accepting our Terms of Service. “BOTM”, “Ourselves”, “Our”, “We” and “Us”, refers to Kourtney Cowart and/or BINS ON THE MOVE, LLC. and/or its employees, representatives, agents, or others for whom we are at law responsible. “Party” or “Parties” refers to both the Renter and ourselves, or either the Renter or ourselves. “Services” refers to any and all services, programs, products and/or other offerings on our website, including, but not limited to the renting, delivery and pickup of the equipment. “Equipment” means any and all equipment rented to the Renter, including but not limited to the bins. “Rental Period” means the period during which the Equipment is rented to the Renter, beginning on the confirmed delivery date and ending on the confirmed pickup date, including any extensions approved by BOTM. “Website” refers to https://binsonthemove.com/ (and/or successor, affiliated or associated domains). These Terms of Service apply to all users of our services and/or equipment. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she/it or they, are taken as interchangeable and therefore as referring to same.
Overview of Services
Upon purchase of our services, BOTM shall rent the Equipment to the Renter for the Rental Period. BOTM will deliver the Equipment to the delivery address provided by the Renter and, at the end of the Rental Period, pick up the Equipment from the pickup address provided by the Renter. BOTM does NOT provide packing or moving services. Packing, loading, transportation of the Renter’s belongings, unloading and unpacking are the sole responsibility of the Renter. All Equipment shall remain the sole and exclusive property of BOTM at all times.
Rental Period
BOTM’s standard minimum Rental Period is fourteen (14) days. If the Renter chooses to return the Equipment before the end of the Rental Period, no refund or credit will be issued for unused rental days. The Renter may select a longer Rental Period when placing an order, subject to Equipment availability. Any request to extend the Rental Period after the rental has begun is subject to Equipment availability and additional rental charges.
Delivery and Pickup area
BOTM provides delivery and pickup services within its designated service area. Applicable delivery and pickup fees are determined based on location and will be displayed or communicated to the Renter prior to purchase. BOTM may, in its sole discretion, provide service outside of its standard service area for an additional fee. The Renter must provide accurate delivery and pickup addresses, and both locations must be within an area that BOTM agrees to service.
Reserving Equipment
Equipment may be reserved through BOTM’s website. The Renter is responsible for providing accurate and complete information when placing an order, including the requested quantity of Equipment, Rental Period, preferred delivery date, delivery address, and any other information requested during checkout. All reservations are subject to Equipment availability. In the event BOTM is unable to fulfill an order as requested, BOTM will contact the Renter to discuss available alternatives or issue a refund for any amounts paid for Equipment or services BOTM is unable to provide.
Payment
Payment for the initial order is due in full at the time the order is placed. The Renter must provide a valid payment method at checkout. BOTM uses Stripe, a third-party payment processor, to securely process payments and store payment information. BOTM does not have access to the Renter’s full credit card number.
All fees are exclusive of applicable taxes unless otherwise stated. The Renter is responsible for any applicable taxes imposed on the purchase or use of BOTM’s services. Except as otherwise expressly provided in this Agreement, all amounts paid are final and non-refundable.
Changes to Order
The Renter should contact BOTM as soon as possible to request any changes to an existing order, including changes to delivery or pickup dates, the Rental Period, or the quantity or type of Equipment rented. All requested changes are subject to Equipment availability and approval by BOTM.
If an approved change results in additional charges, including additional rental days, Equipment, delivery or pickup fees, the Renter authorizes BOTM to charge the applicable amount to the payment method on file. BOTM will communicate any applicable additional charges associated with the approved change to the Renter.
If an approved change made prior to delivery results in a reduction to the original order, BOTM may refund the applicable difference to the Renter’s original payment method. Once Equipment has been delivered, no refund or credit will be issued for reducing the quantity of Equipment or returning Equipment before the end of the Rental Period.
Cancellation Policy
If the Renter cancels an order more than forty-eight (48) hours before the confirmed delivery date, BOTM will issue a refund to the original payment method, less a fifteen-dollar ($15.00) cancellation fee.
If the Renter cancels an order within forty-eight (48) hours of the confirmed delivery date but before the Equipment has been delivered, no refund will be issued. The amount paid will instead be provided as a credit that may be applied toward a future BOTM rental within twelve (12) months of the original confirmed delivery date. Any unused credit will expire after twelve (12) months and has no cash value.
Once the Equipment has been delivered, the order is non-refundable and no credit will be issued, including if the Renter returns the Equipment early or no longer needs some or all of the Equipment.
Delivery
- The Renter will provide a preferred delivery date and delivery address when placing an order. Preferred delivery dates are subject to availability and are not guaranteed until confirmed by BOTM.
- BOTM will confirm the delivery date and coordinate the approximate delivery time with the Renter prior to delivery. The Renter is not required to be present for delivery if the Equipment can be safely left at the delivery location.
- The Renter is responsible for ensuring that BOTM has safe and reasonable access to the delivery location. The Renter must notify BOTM in advance of any conditions that may affect delivery, including gated access, restricted access, stairs, elevators, parking restrictions, or other circumstances that may require additional time or effort. Additional fees may apply and may be charged to the Renter’s payment method on file.
- BOTM reserves the right to change a confirmed delivery date or approximate delivery time due to weather, emergencies, or other unforeseen circumstances. BOTM will make reasonable efforts to notify the Renter of any such change and coordinate an alternate delivery date or time, if necessary.
Pickup
- The Renter will provide a preferred pickup date and pickup address when placing an order. If the pickup date or address is not known at the time the order is placed, the Renter must provide that information to BOTM as soon as possible and no later than forty-eight (48) hours before the end of the Rental Period. Pickup dates are subject to BOTM’s availability.
- BOTM will confirm the pickup date and coordinate the approximate pickup time with the Renter. The Renter is not required to be present for pickup if the Equipment is left in a safe, accessible location agreed upon with BOTM.
- All Equipment must be empty, reasonably free of debris, and ready for pickup on the confirmed pickup date. The Renter must remove all labels from the bins prior to pickup. Bins should be nested together, and any dollies or other Equipment should be placed with the bins. The Renter is not required to wash or sanitize the Equipment. The Renter is responsible for ensuring that BOTM has safe and reasonable access to the Equipment.
- The Renter must notify BOTM in advance of any conditions that may affect pick up, including gated access, restricted access, stairs, elevators, parking restrictions, or other circumstances that may require additional time or effort. Additional fees may apply and may be charged to the Renter’s payment method on file.
- BOTM reserves the right to change a confirmed pickup date or approximate pickup time due to weather, emergencies, or other unforeseen circumstances. BOTM will make reasonable efforts to notify the Renter of any such change and coordinate an alternate pickup date or time, if necessary. If BOTM reschedules or delays pickup for reasons not caused by the Renter, the Renter will not be charged additional rental fees for the period between the originally confirmed pickup date and the date BOTM retrieves the Equipment.
Failed or Delayed Pickup
- The Renter is responsible for ensuring that all Equipment is ready and accessible for pickup on the confirmed pickup date. If BOTM is unable to retrieve the Equipment due to circumstances within the Renter’s control, including inaccessible Equipment, locked or gated access, incorrect pickup information, or Equipment that is not ready for pickup, the pickup will be considered unsuccessful.
- If a pickup is unsuccessful due to circumstances within the Renter’s control, additional pickup fees may apply and additional rental charges will continue to accrue until the Equipment is made available and successfully retrieved by BOTM. The Renter authorizes BOTM to charge applicable additional rental and pickup fees to the payment method on file.
- If, due to circumstances within the Renter’s control, the Equipment has not been made available for retrieval within fourteen (14) days following the end of the original or approved extended Rental Period, BOTM may consider the Equipment unreturned and charge the applicable replacement fees set forth in this Agreement. The Renter remains responsible for any additional rental and pickup fees accrued prior to the Equipment being considered unreturned. Payment of replacement fees does not prevent BOTM from pursuing any other remedies available to recover amounts or Equipment owed to BOTM.
Condition of Equipment
- BOTM will provide Equipment in good working condition, subject to normal wear and tear. The Renter is responsible for inspecting the Equipment after delivery and notifying BOTM of any existing damage or condition concerns within twenty-four (24) hours of delivery.
- If the Renter reports existing damage within twenty-four (24) hours, BOTM will determine whether the affected Equipment needs to be replaced or otherwise addressed. The Renter will not be responsible for damage that existed prior to delivery and was timely reported to BOTM.
- If the Renter does not report existing damage within twenty-four (24) hours of delivery, the Equipment will be considered to have been received in acceptable condition.
Payment Method on File & Authorization for Additional Charges
- The payment method used by the Renter to place an order will be securely stored by BOTM’s third-party payment processor, Stripe, for the duration of the Rental Period and until all Equipment has been returned and all amounts owed to BOTM have been paid. BOTM does not have access to the Renter’s full credit card number.
- By placing an order and agreeing to this Agreement, the Renter expressly authorizes BOTM to charge the payment method on file for additional amounts that become due under this Agreement. Such charges may include, but are not limited to, approved rental extensions, additional Equipment requested by the Renter, cleaning fees, replacement costs for damaged, lost, stolen or unreturned Equipment, additional delivery or pickup fees, and other applicable charges specifically described in this Agreement.
- BOTM will only charge the payment method on file for amounts permitted under this Agreement. If a charge is declined or otherwise unsuccessful, the Renter remains responsible for all amounts owed to BOTM.
Cleaning Fees
BOTM cleans and sanitizes the Equipment prior to delivery. The Renter is not required to wash or sanitize the Equipment before pickup; however, all Equipment must be returned empty and reasonably free of debris.
If Equipment is returned with excessive dirt, debris, pet fur, food, liquids, residue, or other conditions requiring cleaning beyond BOTM’s standard cleaning and sanitizing process, BOTM may charge a cleaning fee of $5.00 per affected piece of Equipment to the Renter’s payment method on file.
Replacement Fees
The Renter is responsible for the care and return of all Equipment rented from BOTM. If Equipment is lost, stolen, not returned, or damaged beyond normal wear and tear to the extent that BOTM determines the Equipment is no longer reasonably usable, the following replacement fees will apply:
- Bins: $50.00 per bin
- Dollies: $100.00 per dolly
BOTM may charge applicable replacement fees to the Renter’s payment method on file. If Equipment is damaged but remains usable, BOTM may charge the Renter for the reasonable cost of repair or remediation rather than the full replacement fee.
The Renter is responsible for keeping the Equipment in a secure location and protecting it from theft, loss, or damage during the Rental Period. The Renter remains responsible for Equipment that is lost, stolen, not returned, or damaged beyond normal wear and tear, regardless of whether the loss or damage was caused directly by the Renter.
The Renter shall not apply tape, adhesive materials, stickers, or labels to the Equipment other than labels provided by BOTM. BOTM-provided labels must be removed by the Renter prior to pickup. Any alteration or modification of the Equipment is prohibited without BOTM’s prior written consent.
DISCLAIMER NOTICE – Exclusions and Limitations
By purchasing and/or using our services and/or equipment, you acknowledge and agree that there is a serious risk of injury and death in using such equipment, that you have satisfied yourself that you and all who will be using the equipment are physically, emotionally and mentally able to use our equipment and that the sole risk and responsibility for personal safety in the use of our equipment remains with you.
To the fullest extent permitted by law, we:
- exclude all representations and warranties related to BOTM’s website, services, equipment and their contents or which is or may be provided by any affiliates or any other third party, except such warranties explicitly set out herein; and
- exclude all liability for damages arising out of or in connection with your purchase and/or use of our services and/or equipment, including, but not limited to, for personal injury, death or property damage.
In no event will we be liable to you (and/or your heirs, executors or other representatives) for any special, indirect, incidental, consequential or punitive damages arising out of or in connection with our services, whether such liability arises from contract, warranty, tort (including negligence), strict liability or otherwise and whether or not we have been advised of the possibility of such loss or damage and by accepting this Agreement you hereby RELEASE and FOREVER DISCHARGE us of any claims, losses, damages, liabilities and expenses for the above, including, but not limited to, litigation expense, legal fees, damage, award or cost, of any form whatsoever arising out of or related to:
- (a) your violation of a provision of this Agreement; and
- (b) your purchase of and/or use of our services and/or equipment
The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
Further, by purchasing and/or using our services and/or equipment, you agree to INDEMNIFY us and to save and hold us harmless from any and all claims, losses, damages, liabilities and expenses, including, but not limited to, litigation expense, legal fees, damage, award or cost, of any form whatsoever arising out of or related to:
- (a) your violation of a provision of this Agreement; and
- (b) your purchase of and/or use of our services and/or equipment
Rules & Warnings
Due to the risk of injury or damage associated with the use, lifting, carrying, stacking, and transportation of the Equipment, the following rules apply:
- Bins shall not be overloaded and must remain at a weight that can be safely lifted, carried, stacked, and transported.
- When packed, bins shall not be stacked more than four (4) bins high.
- The Renter shall use caution when opening, closing, lifting, carrying, and handling the Equipment, including around any exposed rods, hinges, or other components of the bins.
- Children shall not be permitted to play in, climb on, or otherwise misuse the Equipment.
- Animals shall not be placed in or on the Equipment.
- The Equipment shall not be used for any unlawful purpose or in any manner prohibited by this Agreement.
- The Renter is responsible for determining the appropriate and safe method for lifting, carrying, stacking, loading, unloading, and transporting the Equipment and for ensuring that anyone handling the Equipment does so safely.
Termination of Service
Your access to and/or use of our services and/or equipment may be terminated by us at any time in our sole discretion. The Renter hereby acknowledges and agrees that in the event of default hereunder or breach of any of the terms hereunder, BOTM shall be entitled to enter the premises where the equipment is located and remove same and that all costs owing to BOTM from the Renter hereunder, including, but not limited to all costs and expenses to recover the equipment (including legal fees), shall be immediately due and payable by the Renter to BOTM.
Force Majeure
We are not liable to you for any failure to perform any obligation which is due to an event beyond our control including but not limited to any act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood, epidemic, pandemic or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen.
General
By purchasing and/or using our services, you represent that you are at least the age of majority in your state of residence. The laws of Georgia and those of The United States of America are applicable therein govern this Agreement. By purchasing and/or using our services you consent to this Agreement and to the exclusive jurisdiction of the Georgia courts in all disputes arising out of such use. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from this Agreement and the remaining terms will continue to apply. Our failure to enforce any of the provisions set out in this Agreement shall not be construed as waiver of such provisions and shall not affect the validity of this Agreement or any part thereof, or the right thereafter to enforce each and every provision. This Agreement shall not be amended, modified, varied or supplemented except in writing and signed by us.
Notification of Changes
This Agreement were last amended on August 13, 2026. BOTM reserves the right to change this Agreement from time to time as they see fit and the Renter’s continued use of the services will signify their acceptance of any adjustment or amendment to this Agreement. The Renter is therefore advised to re-read this statement on a regular basis.
